Terms of service
Last updated: June 27, 2026
Welcome to Truffle Coffee. These Terms of Service ("Terms") govern your use of our website at trufflecoffee.co (the "Site") and any orders you place with us. Please read them carefully. We've tried to keep them friendly and plain-spoken, but they are a binding agreement, so the details matter.
1. Acceptance of These Terms
When you place an order, we ask you to affirmatively agree to these Terms at checkout by checking a box confirming that you have read and agree to these Terms of Service, our Refund & Return Policy, Shipping Policy, and Privacy Policy — each of which is incorporated here by reference. You must check that box to complete your purchase, and we record your agreement (including the date, time, and IP address associated with it) as part of your order.
Browsing the Site or creating an account also indicates your agreement to these Terms. If you do not agree, please do not use the Site or place an order.
2. Who We Are
The Site and the Truffle Coffee brand are operated by C and D Ventures LLC d/b/a Truffle Coffee ("Truffle Coffee," "we," "us," or "our"), an Ohio limited liability company. You can reach us anytime by email at support@trufflecoffee.co.
Our coffee is roasted fresh in small batches in California and shipped to your door. Every order is handled with the same care we'd give a gift to a friend.
3. Eligibility
To order from us, you must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. We sell and ship within the United States only. We do not ship internationally and do not ship to APO/FPO or other military or overseas addresses. By placing an order, you confirm that you meet these requirements and that your shipping address is within the United States.
4. Products, Pricing & Availability
We do our best to describe our coffees and teas accurately and to show current prices, but we cannot guarantee that every detail, image, or description is complete or error-free. Colors, roast appearance, and packaging may vary slightly.
- Prices and availability are subject to change without notice. A product appearing on the Site is not a guarantee that it will be in stock.
- Free shipping. We're proud to offer free shipping to the customer on every order within the United States — no minimums, no surprises at checkout. Shipping cost is included in the experience as our way of saying thank you.
- Right to refuse, limit, or cancel. We reserve the right, at any time and for any lawful reason, to limit order quantities, refuse service, or refuse or cancel any order — including orders that we believe were placed by automated means, in violation of these Terms, for resale, or that we reasonably suspect are fraudulent.
- Pricing errors. If a product is listed at an incorrect price or with incorrect information due to a typographical, technical, or other error, we reserve the right to refuse or cancel any order placed at that price, whether or not the order has been confirmed or your payment method charged. If we cancel an order after you've been charged, we will issue a full refund of the amount paid.
5. Orders, Payment & Your Information
When you place an order, you are making an offer to purchase. Your order is accepted only when we send an order confirmation or ship the product. By submitting an order, you authorize us (and our payment processors) to charge your payment method for the total amount, including any applicable taxes.
You agree to provide current, complete, and accurate purchase and account information, and you are responsible for the accuracy of your account, billing, and shipping details — including the delivery address and your grind, size, and product selections. Because orders enter fulfillment quickly, please review everything carefully before you check out. We are not responsible for orders delayed, misdelivered, or undeliverable because of an incorrect or incomplete address or selection you provided, and corrected reorders in those cases may be at your expense, as described in our Refund & Return Policy. (That policy also explains our short order-change and cancellation window.)
6. About Truffle Coffee
Truffle Coffee is a small, independent specialty coffee company. Anything we share about our brand or story is provided for your information only and does not change your rights or remedies under these Terms or our Refund & Return Policy.
7. Shipping, Returns & Refunds
Shipping timelines, our United-States-only delivery area, and our return, replacement, and refund practices are described in our Shipping Policy and Refund & Return Policy, which form part of these Terms. Shipping and delivery times are estimates, not guarantees, and once a package ships, its progress is in the carrier's hands.
Coffee and tea are perishable food products, so we cannot accept physical returns of product — opened or unopened — because returned food must be discarded for safety reasons. Instead, when something goes wrong, we'll make it right through a replacement, store credit, or refund, at our discretion (replacements may be of equal or lesser value), as described in our Refund & Return Policy, rather than asking you to ship food back to us. Please review that policy for the report windows, the photo we'll ask for, what we cover, and the limited exceptions.
Bulk and wholesale orders (5lb, 12lb, and large-quantity orders) are sold as final sale: they are not eligible for taste-based or change-of-mind refunds, or for the satisfaction courtesy described above. If a bulk order arrives wrong, or damaged or defective on arrival, we will still make it right at our discretion — email us a photo within 7 days of delivery. Carrier-related loss or damage to a bulk order is handled through a carrier claim. This is mirrored in our Refund & Return Policy.
8. Intellectual Property
The Site and its contents — including the Truffle Coffee name and logo, text, graphics, photography, product descriptions, page layouts, and other materials — are owned by or licensed to C and D Ventures LLC and are protected by U.S. and international intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Site for your own shopping and personal use. You may not copy, reproduce, republish, sell, or otherwise exploit any part of the Site or its content for commercial purposes without our prior written permission. All trademarks, service marks, and trade names not owned by us are the property of their respective owners.
9. User Conduct
When using the Site, you agree not to:
- use the Site for any unlawful, fraudulent, or unauthorized purpose;
- place orders using false, misleading, or another person's information;
- attempt to gain unauthorized access to the Site, other accounts, or our systems;
- interfere with or disrupt the Site, including by introducing viruses, bots, scrapers, or other harmful or automated tools;
- resell our products without our written authorization; or
- infringe our intellectual property or that of anyone else.
We may suspend or terminate your access, and refuse or cancel orders, if we believe you have violated these Terms.
10. Disclaimers — "As Is"
The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.
We make every effort to deliver fresh, high-quality coffee and tea. Food allergy and sensitivity note: our coffees and teas may be produced in facilities that also handle nuts, dairy, soy, wheat, or other allergens, and flavored varieties may contain or come into contact with allergens. We cannot guarantee that any product is free from any particular allergen. If you have a food allergy or dietary concern, please review the product information and contact us at support@trufflecoffee.co before ordering. You are responsible for reviewing ingredients and inspecting products before consumption.
Nothing in these Terms is intended to disclaim any warranty or right that cannot be excluded or limited under applicable law, including the Ohio Consumer Sales Practices Act and other consumer-protection laws that apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, C and D Ventures LLC, its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Site or any products purchased from us — whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
In all cases, our total aggregate liability to you for any claim arising out of or relating to the Site, a product, or these Terms will not exceed the amount you actually paid for the specific order giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless C and D Ventures LLC and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of anyone else.
13. Governing Law & Venue
These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that proceeds in court will be the state or federal courts located in the State of Ohio, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim in your home jurisdiction.
14. Dispute Resolution; Class-Action Waiver; Time Limit
We'd much rather talk it out than fight it out. If you have a concern, please contact us first at support@trufflecoffee.co — most issues are resolved quickly and informally. If we can't resolve a dispute that way, you and we agree to try in good faith to settle it before starting any formal proceeding. Any claim not resolved informally will be brought exclusively in the courts identified in Section 13, subject to your rights under applicable consumer-protection law. Nothing in this section limits your ability to bring an eligible claim in small-claims court.
Individual claims only. To the fullest extent permitted by law, you and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action.
Time limit for claims. To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms, the Site, or any product you purchase from us must be filed within one (1) year after the claim arises; otherwise it is permanently barred. Some jurisdictions do not allow these limitations, so they may not apply to you, in which case they apply to the maximum extent permitted by law.
15. Chargebacks & Payment Disputes
If you ever have a problem with an order, please contact us first at support@trufflecoffee.co — we can almost always sort it out faster and more kindly than a bank dispute can. Initiating a chargeback or payment dispute for a valid, delivered order, or for an order issue we were given no reasonable opportunity to resolve, is a breach of these Terms, and you agree we may treat it as one. We keep records of each order — including your agreement to these Terms, your order confirmation, and carrier tracking and proof of delivery — and we reserve the right to use them to respond to and contest disputes we reasonably believe are invalid or fraudulent, while always preserving your rights under applicable consumer-protection law.
16. Force Majeure
We are not liable for any delay in or failure of performance — including delays in fulfillment, shipping, or delivery — caused by events beyond our reasonable control. These may include carrier delays or service failures, weather, fire, flood, or other natural events, labor disputes, ingredient, packaging, or supply shortages, disruptions in fulfillment operations, utility, internet, or payment-system outages, acts of government, public-health emergencies, or other causes we could not reasonably foresee or prevent. If such an event occurs, we will make reasonable efforts to perform as soon as practicable; where it materially affects your order, your remedy is the cancellation-and-refund or replacement options described in our Refund & Return Policy.
17. California Users
Under California Civil Code Section 1789.3, California residents are entitled to the following notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. You may also reach us at support@trufflecoffee.co with any complaint or to request more information about our products and services. For details on how we handle personal information — including any "Do Not Sell or Share My Personal Information" rights — please see our Privacy Policy.
18. Survival
Sections 5 (with respect to any accrued payment obligations), 8 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 13 (Governing Law & Venue), 14 (Dispute Resolution; Class-Action Waiver; Time Limit), 15 (Chargebacks & Payment Disputes), 16 (Force Majeure), 20 (Severability & Entire Agreement), and this Section 18 survive any termination or suspension of your access to the Site and the completion of your order.
19. Changes to These Terms
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above and post the new version on this page. Changes are effective when posted, and we'll ask you to agree to the then-current Terms each time you place a new order. Your continued use of the Site or placement of new orders after changes are posted means you accept the updated Terms. Orders already placed are governed by the Terms in effect at the time of your order.
20. Severability & Entire Agreement
If any part of these Terms is found unenforceable, the rest remains in full effect, and the unenforceable part will be applied to the maximum extent permitted by law. These Terms, together with the policies referenced in Section 1, are the entire agreement between you and us regarding your use of the Site and your purchases, and supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of it.
